Where do these T&C apply to?
Any booking with WAYNABOX is subject to these general terms and conditions of sale, which are published here freely so that each CUSTOMER (whether or not they are the user of the service) can know and verify the purchase and specific terms.

The GENERAL TERMS aim to regulate the contractual terms for the provision of SERVICES by WAYNABOX, and where applicable, the payment owed by the CUSTOMER to WAYNABOX for their use of certain SERVICES. The provision of the SERVICES will be carried out through the acquisition, provision, organization, use, and management by WAYNABOX of the necessary technical, human, and operational resources, and always in exchange for the applicable prices when the SERVICES are paid. Merely browsing the website https://waynabox.com/en will not be considered a SERVICE.

WAYNABOX particularly protects and looks after the traveler under the terms detailed in these GENERAL TERMS, as well as in the LEGAL NOTICE and PRIVACY POLICY.
Can you change these T&C on the website and products Waynabox offer?
The information contained in these General Terms and Conditions for package travel, as well as the information provided at the pre-contractual stage, is of a general nature. No significant changes to the content are expected, and any modifications will be made exclusively under the terms set out in the Specific Conditions and in certain legally established cases.

WAYNABOX undertakes to provide the traveler with a copy of the package travel contract signed by the parties, no later than within 24 hours of its formalization. The package travel contract will include all conditions governing the booked package travel, specifically the general conditions set out in this text, the pre-contractual conditions, and the specific conditions agreed upon between the agency and the traveler.
Definitions
Package travel: means a combination of at least two different types of travel services for the purpose of the same trip or holiday, provided that the combination is concluded under a single contract, whether or not requested by the traveler. A package travel also includes combinations concluded under several contracts where:

They are made at one of our points of sale.

The combination of travel services is selected before the traveler agrees to pay.

They are offered, sold, or invoiced by WAYNABOX, or where applicable by the retailer, at an all-inclusive or total price.

They are advertised by WAYNABOX, or where applicable by the retailer, as a "package travel".

The contracts allow the traveler to choose from a selection of different travel services.

Furthermore, package travel also includes contracts concluded via https://waynabox.com/en (through a connected online booking process) where the traveler concludes a single contract with WAYNABOX but several with the service providers, no later than 24 hours after confirmation of the last reservation.

A package travel also includes the combination of one travel service (transport, accommodation, car rental) and one or more additional tourist services, provided that:

The tourist services represent at least 25% of the value of the combination and are advertised as a significant feature of the combination; or

The tourist services are only purchased after the performance of one travel service (transport, accommodation, car rental) has begun.

Travel service: Includes passenger transport, accommodation (when not an integral part of passenger transport and not for residential purposes), car rental (Royal Decree 750/2010 of 4 June), and any other tourist service that is not an integral part of the aforementioned services.

Package travel contract: means either a single contract for the entire trip or multiple contracts for each travel service included in the package offered.

Start date of the package travel: means the day on which performance of the travel services included in the contract begins.

Repatriation: the return of the traveler to the place of departure or to another place agreed upon by the contracting parties.

Lack of conformity: failure to perform or improper performance of the travel services included in a package travel.

Traveler: any person who intends to conclude a contract or is entitled to travel under a contract, with the contracting party being of legal age.

Trader: any person attending to travelers in person or online, whether acting as organizer, retailer, facilitator of travel services, or travel service provider.

Organizer: a trader who combines and sells or offers package travel directly or together with another trader, such as WAYNABOX.

Retailer: a trader other than the organizer who sells or offers package travel created by an organizer.

Lack of conformity: failure to perform or improper performance of the travel services included in a package travel contract.

Minor: any person under eighteen years of age.

Unavoidable and extraordinary circumstances: situations beyond the control of the party invoking them and whose consequences could not have been avoided even if all reasonable measures had been taken.

Point of sale: refers to any retail sales outlet, whether fixed or mobile, a retail website, or similar online sales device, even when these websites or devices are presented to travelers as a single device, including telephone sales services.

Establishment: access to and exercise of a self-employed economic activity, as well as the establishment and management of enterprises, particularly companies, under the conditions set by law, for an indefinite period, especially through a stable infrastructure.

Pre-contractual information: means the information that WAYNABOX or, where applicable, the retailer is required to provide to the traveler before the traveler is bound by any contract or offer.
Assistance
The traveler may send messages, requests, or complaints regarding the performance of the package travel contract directly to WAYNABOX or through the retailer through whom it was purchased. The retailer shall forward such messages, requests, or complaints to WAYNABOX without undue delay. For the purpose of meeting deadlines or limitation periods, receipt of the messages, requests, or complaints by the retailer shall be considered receipt by WAYNABOX.

WAYNABOX and the retailer must provide appropriate and timely assistance to the traveler in difficulty, particularly in the case of unavoidable and extraordinary circumstances, in particular by:

providing appropriate information on health services, local authorities, and consular assistance;

assisting the traveler in establishing long-distance communications; and

helping to find alternative travel arrangements.

WAYNABOX and, where applicable, the retailer may charge a reasonable fee for such assistance if the difficulty was intentionally or negligently caused by the traveler. In no case shall such fee exceed the actual costs incurred by the organizer or the retailer.

If it is impossible to ensure the traveler’s return as agreed in the contract due to unavoidable and extraordinary circumstances, WAYNABOX or, where applicable, the retailer shall cover the cost of necessary accommodation, where possible of equivalent category, for a period not exceeding three nights, with any additional costs being borne by the traveler.
Termination of the package travel contract by the traveler
The traveler may terminate the contract at any time, but always before the start date of the package travel, subject to a penalty imposed by WAYNABOX or, where applicable, by the retailer.

WAYNABOX package bookings are non-refundable, meaning that the package travel contract may not be canceled or modified to obtain a full refund under any circumstances.

If no standard penalty is specified in the package travel contract, the amount of the penalty will be equivalent to the price of the package travel, minus any cost savings and income derived from the alternative use of the travel services.

If the booked and canceled services that are part of the package travel are subject to special economic conditions, the cancellation fees for withdrawal will be those established by each service provider.

If, as a result of modifications to the package travel contract conditions, the traveler does not accept the replacement trip, WAYNABOX will refund the amounts paid by the traveler without penalties, within a maximum of fourteen calendar days from the date of contract termination.

The following travelers are entitled to terminate the contract and to a full refund of the package travel price:
  • Travelers whose booked trips are affected by unavoidable and extraordinary circumstances at the destination or nearby, which significantly affect the execution of the trip or the transport of passengers to the destination.
  • If any of the essential elements of the package travel other than the price are significantly modified.
  • If the entrepreneur responsible for the package travel cancels it before the start date; in this case, the traveler is also entitled to receive compensation.
  • In the event of non-performance of services that substantially affect the performance of the package travel and when WAYNABOX or, where applicable, the retailer fails to remedy the problem.
  • When exceptional circumstances occur, such as serious security problems that may affect the trip; in such cases, the traveler will not have to pay any penalties.


Travelers are entitled to a price reduction and/or compensation for damages in the event of non-performance or improper performance of the travel services.

Right of withdrawal: Package travels do not include the right of withdrawal. However, travelers who purchase a package travel outside of a business establishment (not to be confused with distance contracts) will have a period of fourteen days to exercise their right of withdrawal before WAYNABOX.

Contracts concluded outside of a business establishment include:
  • Contracts concluded with the simultaneous physical presence of the trader and the traveler, in a place other than the trader’s business premises.
  • Contracts where the traveler has received an offer under the same circumstances as mentioned above.
  • Contracts concluded on the business premises or by using any means of distance communication immediately after personal and individual contact between the trader and the traveler in a place other than the trader’s business premises.
  • Contracts concluded during an excursion organized by the trader with the aim of promoting and selling products or services to the traveler.
Termination of the contract by the organizer or retailer
WAYNABOX or, where applicable, the retailer may cancel the package travel contract, reimbursing the traveler for all payments made, but without assuming liability for further compensation, provided that the legal conditions established in Royal Legislative Decree 1/2007 of November 16 are met.
Responsibility for booking errors
WAYNABOX will be responsible for errors due to technical faults in the booking system that are attributable to it, as well as for errors made during the booking process when the company has agreed to handle the booking of a package travel.

WAYNABOX will not be responsible for booking errors attributable to the traveler or caused by unavoidable and extraordinary circumstances.
Execution of the package travel contract
WAYNABOX and package travel retailers shall be responsible to the traveler for the proper performance of the travel services included in the contract, according to their respective scope of management of the package travel, regardless of whether these services are to be performed by them or by other service providers.

Notwithstanding the foregoing, the traveler may submit claims for non-performance or improper performance of the services included in the package travel contract either to WAYNABOX or to the retailers, who shall be obliged to inform about the applicable liability regime, to handle the claim directly or by forwarding it to the responsible party according to their scope of management, and to inform the traveler about its progress even if it is outside their scope of management.

The party held liable to the traveler shall have a right of recourse against the entrepreneur responsible for the non-performance or improper performance of the contract, according to their respective scope of management of the package travel.

When WAYNABOX or a retailer pays compensation, grants a price reduction, or fulfills other obligations imposed by this law within their scope of management, they may seek compensation from third parties who contributed to the event that gave rise to the compensation, price reduction, or fulfillment of other obligations.

The traveler must inform WAYNABOX or, where applicable, the retailer without undue delay of any lack of conformity they observe during the performance of a travel service included in the contract.

If any of the services included in the package are not performed in accordance with the contract, WAYNABOX and, where applicable, the retailer shall rectify the lack of conformity, unless this is impossible or entails disproportionate costs, taking into account the seriousness of the lack of conformity and the value of the affected travel services. If the lack of conformity is not remedied under this section, a price reduction and compensation for damages shall apply.

Without prejudice to the exceptions provided in the preceding paragraph, if WAYNABOX or the retailer does not remedy the lack of conformity within a reasonable period set by the traveler, the traveler may do so themselves and request reimbursement of the necessary expenses. The traveler shall not be required to specify a time limit if WAYNABOX or, where applicable, the retailer refuses to remedy the lack of conformity or if an immediate solution is required.

If a significant proportion of the travel services cannot be provided as agreed in the package travel contract, WAYNABOX or, where applicable, the retailer shall offer the traveler, at no additional cost, suitable alternative arrangements of an equivalent or higher quality to those specified in the contract, including when the traveler’s return to the place of departure is not carried out as agreed.

If the proposed alternative arrangements result in a package travel of lower quality than that specified in the contract, WAYNABOX or, where applicable, the retailer shall grant the traveler an appropriate price reduction.

The traveler may only reject the proposed alternative arrangements if they are not comparable to those agreed in the package travel contract or if the price reduction granted is inadequate.

If a lack of conformity substantially affects the performance of the trip and WAYNABOX or, where applicable, the retailer has not remedied it within a reasonable period set by the traveler, the traveler may terminate the contract without paying any penalty and, where applicable, request both a price reduction and compensation for the damages caused.

If the package travel includes passenger transport, WAYNABOX and, where applicable, the retailer shall also repatriate the traveler using equivalent transport without undue delay and at no additional cost in the cases mentioned in the previous two paragraphs.

If it is impossible to ensure the traveler’s return as agreed in the contract due to unavoidable and extraordinary circumstances, WAYNABOX or, where applicable, the retailer shall bear the cost of necessary accommodation, if possible of equivalent category, for a period not exceeding three nights per traveler. Where European Union passenger rights regulations applicable to the relevant means of return transport provide for longer periods, those periods shall apply.

The cost limitation referred to in the preceding paragraph shall not apply to persons with disabilities or reduced mobility as defined in Article 2(a) of Regulation (EC) No. 1107/2006 of the European Parliament and of the Council of 5 July 2006 concerning the rights of disabled persons and persons with reduced mobility when travelling by air, nor to their accompanying persons, pregnant women and unaccompanied minors, as well as persons requiring specific medical assistance, provided that their particular needs have been communicated to WAYNABOX or, where applicable, the retailer at least forty-eight hours before the start of the trip. WAYNABOX and the retailer may not invoke unavoidable and extraordinary circumstances to limit liability if the carrier may not invoke such circumstances under applicable European Union regulations.
Protection of personal data
In compliance with Organic Law 3/2018 of December 5 on the Protection of Personal Data and Guarantee of Digital Rights, and European Regulation 2016/679 on the protection of natural persons with regard to the processing of personal data and the free movement of such data, both the agency and the traveler commit to respecting and complying with the current regulations in this matter.

If a contract is indeed entered into with WAYNABOX, the information regarding data protection will be provided by WAYNABOX to the traveler at the time established by law. Likewise, you can consult our privacy and data protection policy at https://waynabox.com/es/terminos-y-condiciones.
Limitation period for actions
Actions arising from the rights recognized by the Law shall be subject to a limitation period of two (2) years. The limitation period shall begin on the day the contract is concluded.
Applicable jurisdiction
The parties entering into a contract under these general terms and conditions shall submit to the courts of the traveler’s domicile or the domicile of the business, at the traveler’s choice, to resolve any disputes or claims arising from the interpretation or execution of the package travel contract and these general terms and conditions.
